    Fair Use Policy

    How we keep the service fast, reliable and fairly available to every customer, and the use that falls outside that.

    Forms part ofthe Terms of Service

    This Fair Use Policy explains how we keep the Outcome1.AI service (the "Service") fast, reliable and fairly available to all of our customers, and what we consider to be use that falls outside fair and reasonable bounds. It forms part of our Terms of Service and uses the definitions there. It is offered by Outcome1 SRL, whose full company details are in our Privacy Policy.

    How this fits with our Acceptable Use Policy

    This policy sits alongside our Acceptable Use Policy. The Acceptable Use Policy covers lawful and responsible use, what you may not do with the Service. This policy covers fair and reasonable use of the Service's capacity, how much you can use it and the conduct that undermines fair use for everyone. Both form part of your agreement with us.

    01 About this policy

    We want the Service to be fast and reliable for everyone who uses it. Almost all of our customers use the Service in exactly the way it is intended, and this policy will never affect them. It exists to set clear expectations about fair and reasonable use, and to let us act in the rare cases where use is excessive or abusive in a way that affects the Service or other customers. It applies to every Customer and Authorised User.

    02 What fair use means

    Your subscription gives you access to one or more Digital Employees, each provisioned for a defined role. We design that access for genuine business use, at a level consistent with how the role would be used in normal operations. Because a Digital Employee draws on real computing resources to do its work, fair use means using the Service for your own legitimate business purposes, within the role each Digital Employee is provisioned for, and at a reasonable level, rather than in ways that are excessive, abusive, or designed to extract value the subscription is not intended to provide.

    03 Reasonable use of your Digital Employees

    We expect each Digital Employee to be used for the role it is provisioned for, at a level of activity consistent with that role in a business of your size and type. Where your plan or Order specifies particular usage levels, limits or capacity, those apply as set out in that plan or Order. Where it does not, we apply a reasonable-use standard, judged against typical use of the role in comparable businesses.

    04 Excessive or disproportionate use

    Use that goes well beyond what the role and your subscription contemplate is not fair use. Examples include:

    • driving volume far in excess of normal business operation for the role;
    • using automated means to multiply requests or to simulate the activity of many users;
    • using a single Digital Employee to perform what is effectively the workload of several; or
    • running workloads that are unrelated to a Digital Employee's provisioned role in order to obtain general-purpose computing capacity.

    05 Misuse and abuse

    You must not, and must not permit anyone to:

    • circumvent, or attempt to circumvent, any usage limit, rate limit or capacity control;
    • share, resell, sublicense or otherwise give third parties access to your Digital Employees or your capacity, except as your agreement expressly allows;
    • share account credentials, or use a single subscription to provide the Service to more than one business; or
    • use the Service in any way that degrades, disrupts or places a disproportionate load on it, or that affects other customers' use of it.

    For unlawful, harmful or otherwise prohibited use, and for conduct such as scraping the Service or building competing products, our Acceptable Use Policy applies in addition to this policy.

    06 Automated and high-volume use

    A reasonable degree of automation is part of how a Digital Employee works, and is expected. What is not permitted is automation designed to evade limits, to generate abusive or disproportionate volume, or otherwise to undermine fair use of the Service.

    07 How we keep use fair

    We may monitor usage of the Service to protect its performance, security and fair availability to all customers. If your use is excessive, or otherwise breaches this policy, we may, proportionately to the circumstances:

    • contact you to discuss your usage and agree a way forward;
    • apply rate limits or throttling to your use;
    • ask you to move to a plan, or add capacity, that fits your usage; or
    • suspend, limit or terminate the Service in line with the Terms of Service.

    Where it is practical, we will give you notice and an opportunity to adjust your usage before taking more serious steps, except where urgent action is needed to protect the Service or other customers.

    08 Plans, capacity and changes

    Your plan or Order sets out the capacity and any usage levels that apply to you. We may define or update fair-use thresholds for the Service from time to time, and where a change is material we will give you reasonable notice. Nothing in this policy reduces any capacity that has been expressly committed to you in a signed Order for the term of that Order.
